NOTICE OF PUBLIC HEARING

ON PROPOSED LOCAL LAW

 

PLEASE TAKE NOTICE that there has been introduced before the Town Board of the Town of Newburgh in the County of Orange and State of New York on November 25, 2024, Introductory Local Law No. 3 of the Year 2024 entitled “A Local Law Amending Section 185.52 Entitled ‘Penalties for Offenses, Jurisdiction’ of Chapter 185 Entitled ‘Zoning’ of the Code of the Town of Newburgh” the purpose and effect of which is to amend the Town’s Zoning Code provisions pertaining to penalties for offenses in order to improve the effectiveness of zoning enforcement through greater judicial efficiency and the deterrence of zoning violations.   The amendments will decrease the maximum imprisonment penalty that may be imposed for a violation to a period not to exceed fifteen days and increase the maximum fines and civil penalties to  $700 for conviction of a first offense; not less than $700 nor more than $1,000  for conviction of a second offense committed within a period of five years of the committing the first offense; and not less than  $1,000 nor more than $1,500  for conviction of a third or subsequent offense, all of which were committed within a period of five years.  The local law is specifically intended to supersede and amend Sections 268 and 135 of the  Town Law of the State of New York:

 

PLEASE TAKE FURTHER NOTICE that pursuant to Section Twenty of the Municipal Home Rule Law, a public hearing will be held on the aforesaid proposed Local Law before the Town Board of the Town of Newburgh at the Town Hall at 1496 Route 300 in the Town of Newburgh, New York at 7:00 o'clock p.m. on March 10, 2025 at which time all interested parties will be heard.
