NOTICE OF ADOPTION

 

PLEASE TAKE NOTICE that on the 23rd day of September, 2024, the Town Board of the Town of Newburgh in the County of Orange, State of New York, adopted Local Law No. 1 of 2024 entitled “A Local Law Amending Section 185-48.9 Entitled ‘Cannabis Related Uses’ of Chapter 185 Entitled ‘Zoning’ of the Code of the Town of Newburgh.” The Local Law amends the Town’s Zoning Code provisions pertaining to cannabis related uses in order to conform with currently adopted New York State regulations.  The amendments include: a modification to provide that no permit or approval shall be granted to Cannabis On-Site Consumption Premises, Microbusiness Facilities, registered organizations adult use cultivator processor distributor retail dispensary licensed pursuant to section 68-a of the Cannabis Law and Cannabis Retail Dispensaries proposed to be located on the same road and within 500 feet of the structure or its grounds occupied exclusively as a public youth facility rather than a community facility; the addition of Cannabis Microbusinesses and Cannabis Microbusiness separate retail premises to the requirement for separation from another premises used for the same category of licensed use by at least a 1,000 foot radius  and removal of the prohibition on Cannabis Microbusiness Facilities being located within 500 feet of the exterior of an existing dwelling unit;  the inclusion of cannabis microbusinesses with on-site retail sales and cannabis microbusiness separate retail premises as uses subject to the additional site requirements for adequate lighting, trash disposal, exterior, grounds, landscaping and sign maintenance and the prohibitions on sales product and paraphernalia items related to the preparation or consumption of product being visible offsite or from a public right of way and use of sound reproduction devices; and the addition of cannabis microbusiness retail premises and cannabis microbusinesses with indoor cultivation canopies only as uses permitted subject to site plan approval by the Planning Board to the B (Business) and IB (Interchange Business) Zoning District Tables of Use and Bulk Requirements subject to the same bulk requirements as cannabis retail dispensaries.



 

The adoption of the Local Law was determined by the Town Board to be an Unlisted Action under the State Environmental Quality Review Act regulations, the approval of which would not have a significant adverse effect on the environment.  A Negative Declaration has accordingly been issued.   

 

A public hearing on the adoption of this Local Law was held on the 23rd day of September, 2024, during which the public had the opportunity to provide comments on behalf or in opposition of the proposed Local Law and any part thereof.  The Town Board has determined it is in the best interest of the Town to adopt this Local Law.
