NOTICE OF ADOPTION
PLEASE TAKE NOTICE that on the 10th day of March, 2025, the Town Board of the Town of Newburgh in the County of Orange, State of New York, adopted Local Law No. 1 of 2025 entitled “A Local Law Amending Section 185.52 Entitled ‘Penalties for Offenses, Jurisdiction’ of Chapter 185 Entitled ‘Zoning’ of the Code of the Town of Newburgh” the purpose and effect of which is to amend the Town’s Zoning Code provisions pertaining to penalties for offenses in order to improve the effectiveness of zoning enforcement through greater judicial efficiency and the deterrence of zoning violations. The amendments will decrease the maximum imprisonment penalty that may be imposed for a violation of the Zoning Code to a period not to exceed fifteen days and increase the maximum fines and civil penalties to $700 for conviction of a first offense; not less than $700 nor more than $1,000 for conviction of a second offense committed within a period of five years of the committing the first offense; and not less than $1,000 nor more than $1,500 for conviction of a third or subsequent offense, all of which were committed within a period of five years. The local law is specifically intended to supersede and amend Sections 268 and 135 of the Town Law of the State of New York:
The adoption of the Local Law was determined by the Town Board to be part of an Unlisted Action under the State Environmental Quality Review Act regulations, the approval of which would not have a significant adverse effect on the environment. A Negative Declaration has accordingly been issued.
A public hearing on the adoption of this Local Law was held on the 10th day of March, 2025, during which the public had the opportunity to provide comments on behalf or in opposition of the proposed Local Law and any part thereof. The Town Board has determined it is in the best interest of the Town to adopt this Local Law.
