Release Date: January 14, 2008

SHOVELING SNOW INTO STREETS IS ILLEGAL,

TOWN OF NEWBURGH SAYS

The Highway Department of the Town of Newburgh has issued a reminder to all residents that shoveling snow into public roadways and thoroughfares is specifically forbidden by the Town Municipal Code.

Chapter 135, Second 2, of the Town Code specifies:   “No person shall throw, put or place or cause to be thrown, put or place any snow or ice into any public highway, street, public place or thoroughfare in the town.”

This section of the Town Code was adopted in 1974.

Darrell Benedict, Town Highway Superintendent, also asks Town residents not to plow snow onto neighbor’s property across the street.

According to the Town Code, the penalties for a violation of this Code include a fine of not more than $250 or imprisonment for not more than fifteen days, or both, for each occurrence of the violation.  Where appropriate, the court may sentence the violator to remove litter or graffiti in a designated are of the Town for a designated period of time under the supervision of an officer or employee designated by the Court.
