PUBLIC HEARING SCHEDULED REGARDING THE CONSTRUCTION OF NEW WATER LINES

NOTICE OF PUBLIC HEARING

 

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Newburgh, Orange County, New York, at a meeting held on the 23rd day of October, 2017, duly adopted the following Order calling a public hearing at the Town Hall at 1496 Route 300, Town of Newburgh, New York on the 27th day of November, 2017 at 7:00 o'clock, p.m., Prevailing Time in the matter of the construction of lateral water mains in the right of way of Rock Cut Road (County Highway No. 23), in easements to be acquired for such purposes running in the rights of way of Leary Lane and Coranas Lane, private roads, and in Little Britain Road (NYS Route 207), in the Consolidated Water District in the Town of Newburgh, Orange County, New York.

The project described above has been determined to be not subject to review pursuant to ECL article 8 and its implementing regulation (6 NYCRR Part 617) [SEQR], as an exempt action pursuant to the enforcement exemption provision of SEQR.

ORDER CALLING PUBLIC HEARING In the Matter of The Construction

of Lateral Water Main EXTENSIONS in the Consolidated Water District in the Town of Newburgh, Orange County, New York

 

 

            WHEREAS, the Town Board of the Town of Newburgh, Orange County, New York on October 23, 2017 adopted a resolution on its  own motion pursuant to Section 199 of the Town Law proposing that the Town Board authorize and approve the construction of lateral water main extensions in the right of way of Rock Cut Road (County Highway No. 23) approximately 1,135 linear feet in length running from NYS Route 17K, in easements to be acquired for such purposes running in the rights of way of Leary Lane, approximately 795 linear feet in length running from NYS Route 17K, and Coranas Lane, approximately 410 linear feet in length running from Old Little Britain Road, private roads, and in Little Britain Road (NYS Route 207) approximately 500 linear feet in length running from Old Little Britain Road, all in the Consolidated Water District of the Town of Newburgh, Orange County, New York (the “Consolidated Water District”); and

 

WHEREAS, the benefited properties include the lots on both sides of Rock Cut Road, Leary Lane, Coranas Lane and Little Britain Road  listed on the annexed Schedule “A”; and

WHEREAS, the improvement proposed is the planning, design, engineering and construction of lateral water mains of the Consolidated Water District, and the maximum amount proposed to be expended is $1,100,000.00; and

WHEREAS, the cost of said improvement, if constructed, shall be borne by the district at large; and

WHEREAS, the lateral water main extensions are proposed to be installed as a remedy and to address impacted private well owners as the result of contamination from  State Super Fund Site Number 336089 and pursuant to 6 NYCRR 375-2.11(b) remedy selection and implementation of remedial actions under Department approved work plans pursuant to ECL article 27, title 13 are not subject to review pursuant to ECL article 8 and its implementing regulation (6 NYCRR Part 617) [SEQR], as an exempt action pursuant to the enforcement exemption provision of SEQR and accordingly this action is exempt from SEQR ; and

WHEREAS, it is now desired to call a public hearing on the question of the construction of said lateral water main extensions in the Consolidated Water District, in the matter described above, including the SEQRA status, and to hear all persons interested in the subject thereof, concerning the same, in accordance with the provisions of Section 199 of the Town Law;

 

NOW, THEREFORE, IT IS HEREBY

ORDERED, by the Town Board in the Town of Newburgh, Orange County, New York, as follows:

Section 1.         A public hearing will be held in the Town Hall, in Newburgh, New York, in said Town, on November 27, 2017, at 7:00 o'clock P.M., Prevailing Time, on the question of the construction of a lateral water main of the Consolidated Water District, in the Town of Newburgh, Orange County, New York, in the manner described in the preambles hereof, and to hear all persons interested in the subject thereof, concerning the same, and to take such action thereon as is required or authorized by law.

Section 2.         The Town Clerk is hereby authorized and directed to cause a copy of the Notice of Public Hearing hereinafter provided to be published once in the official newspaper, and also to cause a copy thereof to be posted on the sign board of the Town, such publication and posting to be made not less than ten, nor more than twenty, days before the date designated for the hearing.  The Town Clerk shall additionally send said notice by regular mail to the last known address of each owner of the properties listed in Schedule A.

Section 3.         The notice of public hearing shall be in substantially the form attached hereto as Exhibit A and hereby made a part hereof.

Section 4.         This Order shall take effect immediately.
